Nobody is asked to believe in the Flying Spaghetti Monster and most Pastafarians say plainly that they do not. This is the fact that decided every court case. In Cavanaugh v. Bartelt the plaintiff was a Nebraska prisoner seeking accommodation for FSMism; Judge John M. Gerrard held on 12 April 2016 that it is not a religion within the meaning of the relevant federal statutes but a parody, intended to advance an argument about science, the evolution of life, and the place of religion in public education. The Dutch Council of State reached the same conclusion on 15 August 2018, observing that the satirical character predominates, and the European Court of Human Rights declared a Pastafarian application inadmissible on 9 November 2021 for want of the seriousness and cohesion Article 9 requires. Against all that stand the passport and driving-licence offices in Austria, the Czech Republic and several American states that have accepted a colander, and New Zealand's Registrar-General, who did not.
The Court finds that FSMism is not a religion within the meaning of the relevant federal statutes and constitutional jurisprudence. It is, rather, a parody, intended to advance an argument about science, the evolution of life, and the place of religion in public education.
